L'impatto dell'intelligenza artificiale sull'università tra tutela dei dati personali e diritto all'istruzione

[Autom. eng. transl.] The virtualization of educational services and the relative maximization of personal data collection and processing activities require additional reflection regarding the risks of further processing. These data, largely of a sensitive nature, constitute precious material for university bodies for carrying out surveys regarding the participation, interests and methods of behavior of the subjects involved, first of all teachers and students. To this end, machine learning techniques and data fusion practices can be used which contribute to increasing the risks for the rights and freedoms of the natural persons involved in the processing. The commercial value of the data collected in this way could lead the universities themselves to enter into transfer agreements with third parties, such as platforms and digital players. Based on these premises, the chapter intends to focus on the role of universities as key figures and data controllers in the personal data protection regime applicable to teaching activities and further processing of the collected data. In the light of the affirmed centrality of both the right to education and scientific freedom in contemporary society, the contribution offers a punctual, necessary and extremely topical reflection on the crucial role of universities in the on-going path towards educational and epistemological models capable of exploiting and develop the potential of AI in a reliable and sustainable way, looking to the knowledge society of the future.
