Abstract

[Autom. eng. transl.] The study focuses on the content of the art. 1453, 2nd paragraph, Civil Code, investigating how far it can extend, after the recent intervention of the sections. a. of the Court of Cassation, the right of ius variandi contained in it and what is the role, within the orientation inaugurated by the SC, of the prohibition, still partially in force, of introducing new constitutive facts in support of the new demand granted to the actor in itinere.
