Abstract
[Autom. eng. transl.] The contribution lists the crises that have allowed the European constitutional framework to adapt to situations for which it was not designed; frames the EU legal system in terms of a functional constitution, a substitute for a federal constitution; sees in the improper European constitution a codification of economic policy, designed to produce effects of social policy; notes the systematic circumvention of the European codification in the name of the various 'emergencies' that have occurred over time, demonstrating the dysfunctionality of the overall system.
