Abstract
[Autom. eng. transl.] The law on the so-called spending review (Decree Law No. 95/2012 in Law No. 135/2012) has introduced significant innovations in the regulation of small municipalities dictated by the Consolidated Law on Local Authorities, affecting the functions, structures, governance and aspects related to the political representation of local administrations. The reform discipline was approved with the aim of pursuing a containment and reduction of public spending. But the effects that may derive from the provisions recently introduced on small Municipalities with populations of less than 5,000 and 1,000 inhabitants, which represent 70.2% of Italian Municipalities, are unclear. The law on the review of public spending opens up a new season of overall reorganization of the system of local autonomies and forces us to rethink the role of small municipalities as local authorities within the Tit. V Cost .. The article deals with the issue of the mandatory exercise in associated form of the functions and services of small Municipalities after the spending review and has the purpose of assessing the repercussions that the reform law has on the configuration of small Municipalities as entities local within the constitutional system in relations with state and regional authorities.
