Abstract
The author comments on the decision of the Constitutional Court n. 95/2016, which affirmed the conformity to the Constitution of the public employment regulation containing the prohibition of paying indemnities for the annual leave not enjoyed. The author concludes that, notwithstanding the constitutional conformity, it is doubtful that the regulation is consistent with the principle of the European law in this field.
