Abstract

[Autom. eng. transl.] The essay analyzes the conditions for the expression of public powers not to constitute a mere expression of power, examining the role of the notions of democracy and division of powers. It is highlighted how the very concept of democracy has been polluted by the conflictual logic inherited from the retributive model of justice, a model involving possible consequences of catastrophe for humanity given the war instruments currently available. The unsustainability of that model is highlighted both from a penal point of view and from a theological point of view. A review of the democratic model is envisaged which will revitalize the role of parliaments and know how to weaken a priori logics of opposition. It is highlighted how such a perspective can open towards the progressive affirmation of the idea of ​​a universal brotherhood.
