Abstract
[Autom. eng. transl.] The article analyzes the issue of the right to disconnect under the Italian legal system. Introduced for the first time in 2017 with the law governing agile work, the effectiveness of this right
has been severely tested by the pandemic and emergency regulations. The article accounts for the attempts by the European Parliament and the European social partners to introduce a right at European level
upon disconnection. In the meantime, it appears necessary to leverage the general principles of the legal system and the rules already present on the subject of working hours to ensure this right for all employees.
