[Autom. eng. transl.] The Council of State, in deciding the question of jurisdiction over a dispute concerning a selective procedure called by a public company, defines the general characteristics of public companies, based on the fundamental distinction between business activities of public bodies and administrative activity carried out with privatistic tools, and the interpretative criteria to qualify a subject as a body governed by public law. The results of the reconstruction, however, present some gray areas.
