[Autom. eng. transl.] With reference to the entitlement to participate in tenders for service contracts, the EU competition principles preclude discrimination based on the merely formal data of the role assumed by economic operators: it follows that even a cooperative company can participate in a tender for the award of a service contract, reserved by the notice to the "joint-stock companies"; moreover, following the corporate law reform pursuant to Legislative Decree 17 January 2003, n. 6 ("organic reform of the regulation of corporations and cooperative societies"), a substantial assimilation of cooperative societies to corporations took place.
