Abstract
[Autom. eng. transl.] The paper analyzes the problematic distinction between possible malice and conscious guilt, in light of a tragic accident at the work that took place at the ThyssenKrupp Steelworks in Turin and which caused the death and injuries of numerous workers. Taking a cue from the Turin Court of Appeal's ruling, which acknowledged the responsibility for conscious negligence, instead of that for possible malice affirmed by the Court of first care, the Author analyzes the delicate problem of the distinction between possible intent and guilt conscious, explaining for what reasons, in this case, the conclusions reached by the superior judge are more satisfying from a legal point of view.
