Abstract

[Autom. eng. transl.] The recent law on false social communications seems to be the result of the legislator's awareness of the importance of an environment conducive to doing business, which constitutes an objective superordinate to the protection of savings as it is functional to the development of the economy. In this perspective, it is possible to interpret the use of the expression "material facts not corresponding to the truth" and the elimination of the reference to the assessments previously contained in the text now reformed. The use of economic foundations makes it possible to rationally explain the diversity of forecasts between listed and unlisted companies
