Abstract

[Autom. eng. transl.] The protection of third parties in good faith, holders of real rights, personal rights of enjoyment, credit and who are in possession of the assets, as well as of the person damaged by the crime, in the face of the adoption of patrimonial ablative measures, have gradually entered the criminal proceedings together with all the problems related to the "substantial" evolution of confiscations and the growing invasiveness of seizures. Legislative interventions that are often not sufficiently thought out thus require a revisiting of the institutions involved from the preliminary investigation phase to the cognition process, up to the execution. The analysis was conducted by giving a systemic reading to the regulatory and jurisprudential updates, of internal and supranational origin, so that the reader can be guided through the meanders of an interpretation that is not always easy.
