Abstract

[Autom. eng. transl.] Subject of the contribution are the work situations of potential or actual religious discrimination originated by the failure to respect the dietary rules prescribed by a religion. It is argued that the guarantee of respect for workers' religious or ideological food rules is not an absolute right. The limits placed on its exercise, in democratic legal systems where it is recognized to all equally, should not however lead to discriminatory situations, likely to be created where the religious demand of a worker in the food sector is accepted, and that is instead rejected of another for non-objective reasons. The dividing line between a legitimate and discriminatory differentiated treatment is not easy to identify in abstract terms, but it is a task that requires a considered assessment, case by case, of the specific circumstances of a given situation.
