Abstract

[Autom. eng. transl.] In this short essay we take into consideration the formula aimed at repressing the "direct facts" to commit a crime - which, widely used by the fascist legislator in reference to the so-called 'terrorist crimes' starting from law n. 2008/1926, it would then have been the basis, as is commonly stated, of the tightening of the codicistic discipline of the attempt through the punishment of the 'preparatory' acts of the crime - to demonstrate how it had actually originated in the discipline of the political crime contained in the Zanardelli code and had been coined in order to guarantee the scope of the offenses punishable only in the 'executive' phase of the crime. Only the choice of the codifiers of the regime to extend the relevance of the punitive attempt to the preparatory acts would therefore have determined - as some disputable judgments of the Special Court for State Security issued between 1926 and 1930 - are on the other hand demonstrating - the attribution of an "authoritarian" meaning to the formula in question.
