Abstract
[Autom. eng. transl.] The work relates to the topic, debated in doctrine and jurisprudence, of the fall in communion of hereditary credits, with the consequent faculty, for each of the participants to it, to act individually to assert the entire common credit. Both the thesis contrary to the fall in communion of credits, and the favorable one, are the object of further study: if the first draws its strength more from a homage to the past than from the analysis of the rules dedicated to the subject, from the second the jurisprudence leads to consequences descending contrary to the very purpose of the fall in communion of credits and more in line, in reality, with the thesis of their automatic division between the heirs.
