Abstract
The paper examines the evolution of environmental law and the concept of environment as a juridical asset, giving an overview of the legislative framework, especially that on environmental damage and remediation. The examination is an opportunity to identify the evolutionary lines of environmental law and to show how it is from studies conducted on these matters that the debate on common assets originates and grows, of which the environment appears to be a specification as well as the archetype.
