Abstract
[Autom. eng. transl.] The essay contains three contributions that examine the Refah case Partisi c. Turkey, on the one hand analyzing the motivational inconsistencies of the ruling of the European Court of Human Rights, and of the other considering the role of the principle of secularism in the legal and ideological system of the Republic of Turkey.
