Abstract

[Autom. eng. transl.] The interest of international law for cultural heritage is relatively recent and has found in some international organizations - both at the universal and regional level - the natural site in which to be pursued. By comparing the regulations developed under the auspices of UNESCO and the Council of Europe, the study analyzes the evolution of the notion of cultural heritage, which diverges from that of cultural heritage and is no longer overlapping or coinciding with it. Furthermore, it highlights the new approach to the theme, which does not only take into account the protection and preservation of the cultural heritage in its materiality in order to pass it on to future generations, but relies on the potential represented by this heritage for the whole of the community and recognizes it as a resource and as an integrated development factor. Finally, since the contribution is part of a broader research on the enhancement of cultural heritage in other legal systems, it highlights how the Italian Code of Cultural Heritage and Landscape seems not to have wanted or been able to fully grasp the solicitations coming from the international context , remaining anchored to a classical conception of cultural heritage and its function.
