Abstract

[Autom. eng. transl.] The Chapter is dedicated to the analysis of crimes against marriage. That for the legislator of 1930 the criminal protection of the family passed first of all through that of the matrimonial institution emerges in indisputable terms from the opening of Title IX with a Head, the first, expressly dedicated to crimes against marriage. The interest of the penal code for the institution of monogamous marriage, accentuated by the constitutional recognition of the family as a natural society founded on marriage, is the object of an interpretative development by jurisprudence, following social and cultural changes that highlight the emergence of new family models and new instances of protection. Crimes against family morality and in particular the crime of incest are particularly expressive of a model of criminal repression that must necessarily deal with the needs of protection of the person, in particular of the minor, in the context of family relationships.
