Abstract
[Autom. eng. transl.] The text outlines the theoretical foundations of a penal model inspired by the criteria of restorative justice (both with regard to the way the intentions of the penal system are understood (as general reinstatement prevention) and with regard to the dynamics of the process and to the relationship with the victim, both with regard to the differences with the positivistic matrix re-education settings. Among other things, the possibilities of impact of this model on the management of non-minor offenses and in relation to the current medium-long term prison sentences are considered. On the other hand, the potential of criminal mediation procedures in the phase prior to the opening of a process is also considered.
