Abstract
[Autom. eng. transl.] The article illustrates the regulatory evolution and the application practice of subrogation operations, focusing in particular on some recent rulings of the Court of Cassation, which have addressed the issue from the point of view of notarial disciplinary responsibility. Unlike the jurisprudence of legitimacy, the author disputes the assimilation of the structure of the transaction pursuant to art. 120-quater t.u.b. to the institution of subrogation by the will of the debtor provided for by art. 1202 of the Italian Civil Code and highlights the differences between the two regulatory provisions.
