Abstract
[Autom. eng. transl.] o study has as its object the problem of the stability of forced sales. In particular, the investigation focused on the reconstruction of the regulation of the certainty of forced sale in three distinct regulatory areas: i) the procedural powers within the expropriation that may oppose the liquidation purposes of the expropriation (for example the conversion or the reduction of the attachment, as well as the renunciation of creditors to the executive process) and the regulation of the effects of the termination of the executive process; ii) the nullity of the acts of the expropriation process; iii) the illegitimacy of the expropriation due to the absence of procedural assumptions (for example, the absence of the enforceable title) and substantial (for example, the non-existence of the credit for which the proceeding takes place).
