The paper will highlight, in the first instance, the elements of novelty that emerge through the institute of juvenile and adult probation (despite some limits of the respective disciplines) with regard to the ordinarymodeof response to the crime. Subsequently, the problems of guarantees dimension that the same institute raises concerning the judicial assessment of the responsibilities will be examined. Moreover, the conclusion will be entirely favourable to the maintenance - and, indeed, to a governed extension - of the role that probation can assume in the field of the (broadly intended) penal sanctions system.
