Abstract

[Autom. eng. transl.] The author analyzes the characteristics that made the Franzese sentence a milestone in Italian jurisprudence on causality, pointing out the importance of the pragmatic approach with which the Supreme Court was able to resolve a complex interpretative contrast, combining in a balanced way institutions of substantive criminal law and dynamics of the procedural assessment. Among the still open problems, on which jurisprudence and doctrine will be called to continue to dialogue in the future, the role of statistical laws with medium-low frequencies are discussed, the characteristics of logical probability and the ascertainment of psychic causality in the hypotheses of concurrence of persons in the crime.
