Abstract
[Autom. eng. transl.] The contribution compares the institution of contractual termination provided for by the New Procurement Code with the old one. The dissonances with respect to the causes of exclusion from participation in public tenders and the difficulties in interpreting the causes are highlighted. Particular attention is given to the anti-mafia legislation and to the jurisprudence that has formed on the subject.
