Abstract
[Autom. eng. transl.] Although the reform of the third sector and the new discipline of the social enterprise have a marked publicity character, they contain provisions of a private nature which have important systematic implications for the law of the firm and of the companies. The article intends to deepen these aspects and, in particular: the confirmation of spas as an efficient business organization model; and the downsizing of the subjective profit-making as an essential element of the case of companies, as well as of the social interest as the point of emergence of the dialectic between shareholders and stakeholders.
