Abstract
[Autom. eng. transl.] In industrial law, retroversion of infringer's profits refers to the practice of returning profits illegally obtained by an infringer to the original trademark owner. In practice, when a company produces and markets counterfeit products of a registered trademark, it earns profits that would have belonged to the owner of the original trademark. The retroversion of profits therefore provides that the infringer is obliged to return these undue profits to the owner of the original trademark as compensation for the damage suffered.
