Abstract

[Autom. eng. transl.] The evolution of pre-contractual responsibility is examined from the mid-nineteenth century when it was developed by Jhering as a culpa in contrahendo. In particular, the lack of communication of a cause of disability and the incorrect breaking of negotiations are considered, the latter discovered by Gabriele Faggella, at the beginning of the 20th century. We focus on the contractual nature of the pre-contractual liability and the indemnifiable damage.
