Abstract

[Autom. eng. transl.] The foundation of the intervention of the joint sections: a critical analysis of the 2003-2008 case law evolution. Existentialist thinking. The three reasons that had justified the circulation of the existential model: a critical examination. The alleged, different content of existential damage with respect to biological damage and non-pecuniary damage. The so-called tripartite division of non-pecuniary damage and the comparison between existential damage and "new" non-pecuniary damage (damage to the rights of the person with constitutional significance). The constitutional significance of non-pecuniary damage. The supposed reduction of the compensation "quantum" and the principle of full reparation of the damage.
