Abstract

[Autom. eng. transl.] The writing highlights the significant shortcomings of the canonical criminal procedure in safeguarding the declared respect for the presumption of innocence of the accused and, in general, the defense guarantees. Emphasis is placed on the problems of managing criminal proceedings even through extrajudicial, i.e. administrative, means. A reflection is carried out on the purposes of the criminal trial (to tell the truth or to condemn?), in comparison with the criminal procedural system in state law. We hope for openness, even in the canonical sphere, to methods of 'restorative justice'
