Abstract
[Autom. eng. transl.] The paper offers an analysis of the role played by the parties in the penal process. The procedural system allows the civil action to be carried out in criminal proceedings, so that the compensation and restitution claims deriving from the crime can be known by the same judge called to decide on the guilt of the accused. At the same time, it is permitted to participate in the trial of the civil responsible for damages resulting from the offending conduct and of the civil obligation for the monetary penalty. The analysis is carried out in the dual perspective, static and dynamic, so as to delineate the role of the secondary actors of the ge the faculties and the rights due to them within the judicial dialectic.
