Abstract

[Autom. eng. transl.] The contribution takes into consideration the theme of "nudge regulation", that is to say the set of tools, mainly based on information, that public authorities could put into practice to promote certain behaviors deemed (by the same regulator) as desirable. Starting from the removal of information asymmetries between regulators and regulated, therefore, the "libertarian paternalism" can become a valid alternative in terms of regulation, to be used to produce a series of legal effects (although not binding) towards its recipients, just like it happens at the community level with soft law tools (such as guidelines or best practices); in this case, it would thus contribute to building a set of methods and norms aimed at spreading socially responsible citizens and businesses to practical institutions.
