Abstract

[Autom. eng. transl.] The essay deals with the history, functions, limits and strengths of ethical coding within legal persons. The survey aims to assess the real chances of preventing criminal offenses attached to ethical codes, framing them within the self-organization of the body requested by the d. lgs. 231/2001. In this sense, the weight of the organizational culture is assessed in the processes of ascription of responsibility to the body and the role that the supervisory body can play in creating a sensitivity inspired by the so-called profitable legality model.
