Abstract
[Autom. eng. transl.] The text offers an organic summary of the reasons that impose the overcoming of remuneration models of justice, also in relation to the needs of preventing illegal conduct. The characteristics of a "design" conception of justice with regard to negative facts are outlined, freed, according to the "restorative justice" model, from the scheme of correspondence. We highlight the importance of reflection far beyond the criminal law. The concepts of mercy and forgiveness are deepened, both from the point of cultural secular elaboration, and on the theological level.
