Abstract
[Autom. eng. transl.] The health emergency has revived the debate on the opportunity to resort to the penal sanction to combat the so-called "Fake news". If there is no doubt that disinformation in the health sector, especially in the current social-media context, could have serious consequences, it is nevertheless necessary to ask whether a possible incrimination intervention would be reconciled with the principles of extrema ratio, offensiveness, determination and precision.
