Abstract
[Autom. eng. transl.] The contribution aims to investigate the necessity and the opportunity of resorting to the penal sanction to contrast disinformation, an ancient phenomenon which, with the advent of social media, has taken on new features and unprecedented damaging potential. The analysis, carried out with particular reference to news that distorts public opinion and to news regarding treatments and vaccines, highlights how the introduction of new incriminating cases would not be reconciled with the principles of extrema ratio, offensiveness, decisiveness and precision, placing in the sense of the preferable enhancement of preventive-cultural strategies.
