La delega di funzioni nell'ambito della tutela della salute e della sicurezza nei luoghi di lavoro, alla luce del decreto correttivo n. 106/2009

[Autom. eng. transl.] The essay analyzes the regulation of the delegation of functions, introduced within the TU n. 81/2008, and the repercussions of this reform on the criminal ground, in relation both to the field of safety at work and, more generally, to the division of tasks and responsibilities within complex organizations. The investigation also examines the liability profile of the entities, pursuant to art. 25septies of Legislative Decree 231/2001, questioning the mechanism for imputing liability to the entity, if the presumed crime of murder or negligent injury is committed by a subject delegated by the employer.
