Abstract

[Autom. eng. transl.] The contribution comments on sentence n. 143 of 2013 with which the Committee declared the partial constitutional illegitimacy of the art. 41 bis op in the part in which it envisaged stingenti limits to the personal and telephone conversations of the prisoner subjected to the 'hard' carecere with his defender. The note highlights how the right of defense of the detainee subjected to a special detention regime with respect to personal interviews can now be fully protected, but at the same time stresses that it cannot be asserted with regard to telephone conversations between legal and assisted
