Abstract
In recent decades, confiscation has been widely used in the Italian criminal law, even in forms that recall the publicatio bonorum of the ancient regime. This essay aims to highlight the most important aspects of evolution of this sanction in the context of continental legal history, especially in order to evaluate the consistency of the recent legislator's choices compared to some protective principles that today appear to be dangerously questioned.
