Abstract
[Autom. eng. transl.] In this paper the author broke the subject of competence and the same configurability of an inhibitory protection in antitrust matters, in the absence of an express provision in this regard. As part of this in-depth analysis, the issue of relations with the administrative proceeding pending before the competition authority or the trial before the administrative judge in relation to the same substantial affair is also addressed.
