Abstract
[Autom. eng. transl.] The European codification, which cannot be superimposed on the traditional idea of codification, would rather be seen as a new ius commune which, without claiming to be absolute or replacing national civil codes, would aim to regulate cross-border relations within the EU, devoting itself to the regulation of obligations and contracts. Examples of such codification are the Principles of European contract law and the European Code of contracts, also for their distance from European law of jurisprudential origin, the result of the interpretative work of the Court of Justice, which is incapable of producing a discipline of general character.
