Abstract
[Autom. eng. transl.] The volume intends to clarify, based on the theological elaboration, the authentic scope of the biblical approach to the theme of justice, and in particular of divine justice, in order to evaluate its possible cultural contribution to the reflection on the reform of penal sanctioning instruments. This taking into account the undue use of religious data, in the history of criminal law, in support of retributive punishment theories. A series of basic nodes of Scripture are examined first, from which emerges the saving characteristic of God's action according to justice, up to the full manifestation of divine justice, according to the Christian faith, in the spending of Jesus according to the logic of love. In particular, the notions of forgiveness and mercy are deepened, taking into account the evolution of the recent debate on the models of penal prevention and the tools of restorative justice. Specific in-depth studies are devoted to the position of the Catechism of the Catholic Church on the punishment and the death penalty, the role of punishment in canonical criminal law, both Latin and Eastern, and the legislation in criminal matters of the Vatican City State. The convergence between sensitivities of a religious nature and contributions oriented towards perspectives of restorative justice is valued.
