Abstract
The EU Court of Justice has often dealt with the possibility of granting supplementary protection certificates for patents which do not protect new active ingredients but inventions relating to known active ingredients. This comment on the Court's judgment in the Abraxis case examines the various rulings on this topic, highlighting the questions still open and focusing on a number of points which, in the Court's case law, have not yet received unequivocal solutions.
