After a brief description of the facts, it critically illustrates, proposing also possible solutions, the main and most original legal issues addressed in a court order. urgency of the Milan Court: the functioning of the statutory clause simul stabunt simul cadent; the conflicts of competence between the administrative body and the control body; reactive measures against resolutions of the board of statutory auditors and, more generally, the admissibility of initiatives pursuant to art. 700 cpc in the context of deliberative procedures of corporate bodies.
