[Autom. eng. transl.] The text complements the volume of which it is the preface, which critically describes the applicative practice, not yet overcome in some countries, of the death penalty, some basic theoretical considerations that make such a form of condemnation unacceptable: in relation to the radical claim of domination, which through it is expressed, on the "being" as a reality that escapes human constitutive powers, to the fact that the death penalty constitutes the paradigmatic manifestation of a justice understood as the correspondence of behaviors, which acts as a multiplier of violence, justifying the negative action towards the "other" on the basis of a negative judgment previously expressed against it, to the contradictory nature of the same, moreover, from the preventive point of view, as it destabilizes, proposing a premeditated lesion of the life that has nothing to do with legitimate defense, the behavioral message of the inalienability of rights fundamental human rights linked to the incriminating rules of the penal system.
