Abstract

The Focus addresses the theme of prostitution as a phenomenon of modernity, starting with the law of February 20, 1958, no. 75, which among the three possible patterns of discipline of this phenomenon - regulator, prohibitionist and abolitionist - opted for the latter. But even the abolitionist model is not free of criticism, for if, on the one hand, it seems to provide a more liberal approach, starting with the recognition of prostitution itself as expression of freedom, on the other hand, having as its end that of striking the sad phenomenon of exploitation, has ended up increasing the difficulties women encounter in the activity of prostitution. The result was a discipline that refers to a free but isolated prostitute, for the provision of a constellation of crimes punishing aid or favor toward the exercise of prostitution. This is a paternalistic approach, that does not distinguish prostitution as a free choice from the one, wich today is often linked to organized crime and trafficking in human beings.
