Abstract

[Autom. eng. transl.] The comment on the sentence of the Court of Cassation, section V Criminal, June 28, 2011 - September 6, 2011, n. 33136 deals critically with the issue of qualification as malpractice or unintentional murder of the so-called «piece» of surgery, consisting in the execution of therapeutic interventions deemed useless for the sole purpose of achieving an economic advantage. In particular, the importance of informed consent for the configurability of hypotheses of criminal responsibility in the medical field, as well as questions concerning the assessment of fraud, are examined in depth.
