[Autom. eng. transl.] The new institutional framework established by the Lisbon Treaty, characterized by the succession of the European Union to the Community and the abolition of the old division into three pillars, includes radical new developments in the field of immigration and asylum. Therefore, the first part of this report aims to assess the impact of the entry into force of the Lisbon Treaty on the achievement of a common European immigration and asylum policy. The second part analyzes the legal framework of competences and relations between institutions determined by Title V of the Treaty on the Functioning of the European Union. Special attention is paid to the Court of Justice of the European Union. The third part deals more specifically with the question of respect for the fundamental rights of migrants in the new institutional framework.
