Abstract

[Autom. eng. transl.] The contribution examines the argumentative path followed by the sentence of 30 April 2015, n. 70, with which the Constitutional Court declared illegitimacy by contrast with Articles 3, 36 and 38 of the Constitution of art. 24, co. 25 of legislative decree 201/2011, converted, with modifications, by art. 1, co. 1 of Law n. 214/2011, in the part in which it limited the automatic revaluation mechanism for the years 2012 and 2013 only to some pension treatments. The Court's decision is analyzed in the light of the previous orientations of the constitutional jurisprudence and of the doctrinal debate.
