Abstract
In the international air transport of persons, regulated by the Montreal Convention of 28 May 1999 and by EC Reg. n. 261/2004, the passenger who claims compensation for the damage caused by denied boarding, from cancellation (default) or delayed arrival of the aircraft compared to the scheduled time (inaccurate fulfilment), must provide proof of the existence of the contract of carriage (i.e. produce the ticket of travel or other equivalent proof) and only attach the default of the carrier; it is up to the latter demonstrate the exact fulfillment of the service or the imputability of the non-performance at random unforeseeable circumstances or force majeure or even the containment of the delay within the materiality thresholds set by art. 6, paragraph 1, EC Regulation n. 261/2004.
